COMMISSION FOR THE CONTROL OF PUBLIC PROCUREMENT PROCEDURES
Commission for the control of public procurement procedures has been established by the Law on Public Procurement (Official Gazette of Montenegro, No. 46/2006).
The Commission consists of three persons: chairman and two members, appointed by the Government for the period of four years.
The Commission has the following responsibilities:
1) to consider complaints submitted by tenderers with regard to the public procurement procedures and decide on them;
2) to examine whether the Law on Public Procurement has been correctly applied and propose and undertake corrective measures in order to provide competitive behaviour among tenderers and transparency of the procurement process;
3) to lay down principles and policies aimed at uniform law application;
4) to perform other duties as defined in the Law on Public Procurement.
Method of work of the State Commission
Matters that are under the responsibility of the State Commission are decided on in the form of written orders and conclusions made at its meetings. The decisions are made by majority vote of present members. Commission members may not abstain from voting. The method of work of the State Commission is specified in its Rules of Procedure.
